[:it]Il Regolamento di procedura del TUB è entrato in vigore il 1 settembre 2022,  il CMS del tribunale avrà presto un sistema di accesso e autenticazione più sicuro; nel frattempo la Corte costituzionale tedesca ha formalmente dichiarato inammissibili gli ultimi ricorsi contro la legge nazionale di ratifica dell’Accordo TUB.

Regolamento di procedura

Il Regolamento di procedura del TUB (Tribunale Unificato dei brevetti) è entrato in vigore il 1 settembre 2022; il testo in inglese è accessibile qui, si attende che siano rese disponibili le versioni in lingua francese e tedesca.

Aumenta la sicurezza del CMS

Il 25 agosto 2022 il team di attuazione del TUB ha annunciato l’adozione di un sistema più sicuro di accesso al CMS (Case Management System) del tribunale. Il nuovo sistema entrerà in funzione durante il mese di settembre 2022 con una procedura di login fondata su una procedura di “strong authentication”, che richiederà un certificato elettronico di identificazione (al posto del precedente login con account e password). Gli utenti dovranno inoltre utilizzare una firma elettronica certificata per firmare digitalmente i documenti legali; questo richiederà l’impiego da parte dell’utente di un dispositivo fisico di sicurezza, ottenibile presso fornitori autorizzati.

Inammissibile la seconda serie di ricorsi costituzionali in Germania

La Corte costituzionale tedesca ha recentemente dichiarato inammissibili, con una decisione formale (disponibile qui in tedesco), gli ultimi ricorsi presentati contro la norma nazionale che aveva autorizzato la ratifica tedesca dell’Accordo sul TUB (leggi la nostra notizia su tali ricorsi).

 [:en]The Unified Patent Court’s Rules of Procedure are now in force and increased security is announced for the court’s case management system; meanwhile, Germany’s Constitutional Court has formally dismissed the second round of appeals against national law on ratification of the UPC Agreement.

Rules of Procedure

The Rules of Procedure of the Unified Patent Court (UPC) came into force on 1 September 2022; the consolidated version of the rules in English can be found here. English is the only language available at the moment, although French and German versions are expected soon.

Increased security for CMS

On 25 August 2022 the UPC’s Implementation team announced the adoption of a new secure system to access the UPC’s Case Management System. The new system will start working later this month, with a login process based on a “strong authentication scheme” requiring an electronic identification certificate (as opposed to the previous account-and-password system). Users will also need to use a qualified electronic signature to electronically sign legal documents; this will require obtaining a physical secure device from an authorized provider.

Second round of German constitutional appeals dismissed

The German Constitutional Court recently issued a formal dismissal (read the decision here, in German) of the latest round of appeals against national legislation enabling Germany’s ratification of the UPC Agreement (more about these appeals here).
