[:it]Dalla data di entrata in vigore del TUB, 1° giugno 2023 secondo le previsioni ufficiali aggiornate al 5 dicembre 2022, entra in vigore anche il brevetto unitario che rende possibile ottenere la concessione del brevetto europeo con effetto in 17 stati dell’Unione Europea senza dover effettuare la convalida del brevetto negli stati di interesse. L’Ufficio Europeo dei Brevetti ha fissato al 1° gennaio 2023 la data di decorrenza dell’applicazione delle misure transitorie volte a favorire l’opzione anticipata per il Brevetto Unitario da parte dei titolari di domande di brevetto europeo.

L’Ufficio Europeo dei Brevetti (EPO) ha annunciato che le sue misure transitorie relative al brevetto unitario entrano in vigore a partire dal 1° gennaio 2023, come da due decisioni del presidente dell’EPO datate 11 novembre 2022.

Le misure transitorie hanno la finalità di favorire i titolari di domande di brevetto europeo che desiderano optare anticipatamente per il brevetto unitario. Le misure si applicano alle domande di brevetto europeo pendenti per le quali il richiedente abbia già ricevuto la comunicazione dell’EPO ai sensi della regola 71(3) della Convenzione sul brevetto Europeo (comunicazione con la quale l’EPO informa il richiedente del testo proposto per la concessione).

Pertanto dal 1° gennaio 2023 i titolari di domande di brevetto europeo che soddisfano il suddetto requisito possono:

richiedere anticipatamente l’applicazione dell’“effetto unitario” al brevetto europeo non appena sia concesso;
richiedere che il provvedimento di concessione del brevetto sia ritardato; ciò al fine di evitare che la propria domanda di brevetto europeo giunga a concessione poco prima del 1° giugno 2023, e di perdere conseguentemente l’opportunità di ottenere un brevetto unitario.

[:en]The European Patent Office has set 1 January 2023 as the starting date for the application of the transitional measures intended to support an early uptake of the Unitary Patent by holders of European Patent Applications; this date remains unchanged regardless of the postponenment of starting date of the Unitary Patent and Unified Patent Court to 1 June 2023.

The European Patent Office (EPO) announced on 14 November 2022 that its transitional measures concerning the Unitary Patent will take effect as of 1 January 2023, as per two Decisions of the President of EPO dated 11 November 2022.

The transitional measures are intended to support an early uptake of the Unitary Patent by European patent applicants. They apply to pending European patent applications for which the applicant has already received the EPO’s communication under Rule 71(3) EPC (by which the EPO informs the applicant of the text intended for grant, but that such text has not yet been approved).

Under the transitional measures, as of 1 January 2023 holders of European patent applications that meet the above requirement may:

file early requests to apply the “unitary effect” to the patent as soon as it is granted;
request a delay in issuing the decision to grant the patent; this is to avoid that applicants for European patents due to be granted shortly before 1 June 2023 miss the opportunity to obtain a Unitary Patent in the transitional phase.

It is interesting to note that under two previous Decisions of the President of EPO (both dated 22 December 2021 and repealed by the Decisions of 11 November 2022), the above transitional measures were to take effect upon the date of the deposit of Germany’s ratification of the Unified Patent Court Agreement.
