[:it]Il Comitato preparatorio del Tribunale unificato dei brevetti (TUB) ha annunciato che l’entrata in vigore dell’Accordo sul TUB è attualmente prevista per il 1 aprile 2023, e che il tribunale inizierà a ricevere ricorsi a partire da tale data.

Secondo la “implementation roadmap” pubblicata dal comitato, il deposito della ratifica dell’Accordo sul TUB da parte della Germania farà scattare (a distanza di un mese) l’inizio del Sunrise period, durante il quale sarà possibile, a certe condizioni, richiedere l’esclusione dalla giurisdizione del TUB del proprio brevetto europeo, già concesso o ancora allo stato di domanda. La data prevista per l’apertura del Sunrise period è il 1 gennaio 2023.

L’annuncio ufficiale precisa tuttavia che la “implementation roadmap” potrebbe subire modifiche poiché fondata sulla situazione corrente del progetto TUB.

Approfondimenti – Il nostro Team TUB[:en]The Unified Patent Court Preparatory team has announced that the entry into force of the UPC Agreement is currently planned to happen on 1 April 2023, with the Court starting to receive cases as from that date.

According to the “implementation roadmap” circulated by the team, the deposit of the ratification UPC Agreement by Germany will trigger (after one month) the beginning of the Sunrise period, during which right holders will be able to request that their granted European patents and their European patent applications be excluded from the jurisdiction of the UPC (so-called “opting out”).

The expected date for the start of the Sunrise period is set as 1 January 2023.

The official announcement points out however that the implementation roadmap might be subject to change, as it is based on the current state of the UPC project.
