Quanti paesi hanno già ratificato l’Accordo sul Tribunale unificato dei brevetti?
L’elenco delle ratifiche dell’Accordo sul Tribunale unificato dei brevetti già depositate ora comprende 13 stati: Austria, Belgio, Bulgaria, Danimarca, Finlandia, Francia, Italia, Lussemburgo, Malta, Paesi Bassi, Portogallo e Svezia, oltre appunto all’Estonia.
Che differenza fa la ratifica dell’Estonia?
La ratifica dell’Estonia non cambia di molto la situazione. E’ vero che il numero 13 è significativo per il Tribunale unificato dei brevetti, poiché il relativo accordo può entrare in vigore soltanto dopo la ratifica di un minimo di 13 stati firmatari.
Tuttavia fra quei 13 stati devono essere obbligatoriamente compresi la Germania, la Francia e il Regno Unito. La Francia ha ratificato l’accordo, ma la Germania e il Regno Unito no.
La legge tedesca di ratifica è oggetto di un ricorso dinanzi alla corte costituzionale nazionale, mentre la ratifica del Regno Unito è in una situazione di incertezza in seguito al referendum sulla Brexit, poiché secondo l’accordo solo gli stati membri dell’Unione Europea possono far parte del Tribunale unificato dei brevetti.
A causa di questi ritardi, il Comitato preparatorio del Tribunale unificato dei brevetti ha recentemente annunciato lo slittamento dell’apertura del tribunale stesso alla prima metà del 2018 .

How many countries have ratified the Unified Patent Court Agreement so far?
The list of ratifications of the Unified Patent Court Agreement now includes 13 states: Austria, Belgium, Bulgaria, Denmark, Finland, France, Italy, Luxembourg, Malta, the Netherlands, Portugal and Sweden as well as Estonia.
What difference does Estonia’s ratification make?
Not much. True, 13 is a meaningful number for the Unified Patent Court because the Unified Patent Court Agreement can only enter into force after ratification by a minimum of 13 signatory states.
However Germany, France and the United Kingdom must mandatorily be among those 13 states. France has ratified the agreement, but the United Kingdom and Germany have not.
An appeal against Germany’s ratification law is pending before the Constitutional Court, and British ratification has been on hold since the Brexit referendum, because according to the Unified Patent Court Agreement only European Union member states can be part of the Unified Patent Court.
Owing to the delays, the Unified Patent Court Preparatory Committee recently postponed the Unified Patent Court’s kick-off to the first half of 2018.
