[:it]Le modifiche riguardanti il ​​design dell’Unione europea in vigore dal 1° maggio 2025 innalzano i limiti sui depositi multipli e introducono nuove tariffe per il deposito e il rinnovo; diamo uno sguardo alle possibili strategie di deposito e rinnovo secondo le nuove regole.

L’8 dicembre 2024 è entrato in vigore il pacchetto di riforma della legislazione sul design dell’Unione europea; le modifiche apportate sia al Regolamento UE 6/2002 sui disegni e modelli comunitari che alla Direttiva UE 98/71 inizieranno a entrare in vigore gradualmente a partire dal 1 maggio 2025.

In particolare segnaliamo che il 1 maggio 2025 entreranno in vigore nuove tasse di deposito e rinnovo per i disegni e modelli dell’Unione Europea, nonché ad una nuova disposizione sui depositi che aumenta il limite al numero di design che possono essere inclusi in una domanda multipla.

Abbiamo provato a simulare su un caso reale possibili strategie di deposito e rinnovo tenendo conto delle nuove regole e tasse.

Deposito di domande per design dell’Unione europea:
nuove tasse e regole

Le nuove tasse di deposito devono essere lette in combinazione con le nuove regole, anch’esse in vigore dal 1° maggio 2025; secondo le quali:

1) nella stessa domanda multipla di registrazione possono essere inseriti disegni appartenenti a classi diverse della Classificazione internazionale dei disegni e modelli industriali prevista dall’Accordo di Locarno.

2) nella stessa domanda di registrazione multipla possono essere inclusi fino a 50 disegni o modelli.

Queste novità possono essere sfruttate per ottenere notevoli risparmi sulle spese di deposito, come mostrato nella simulazione:

Nel 2022 un’azienda automobilistica ha depositato tre domande multiple di design

	Domanda 1	4 diverse interfacce grafiche utente (classe 14 di Locarno). Con le tasse di deposito attuali: 350 € per il primo design 175 € per ciascuno dei 3 design aggiuntivi.
	Domanda 2	2 cerchioni (classe 12 di Locarno). Con le tasse di deposito attuali: 350 € per il primo design e 175 € per il design aggiuntivo.
	Domanda 3	6 fari per auto (classe 26 di Locarno). Con le tasse di deposito attuali: 350 € per il primo design e 175 € per ciascuno dei 5 design aggiuntivi.
		Totale tasse per le domande: 2625 €
		Con le nuove regole e tasse in vigore dal 1° maggio 2025, sarebbe possibile presentare una sola domanda per tutti i 12 design e costerebbe solo 1725 €, con un risparmio di ben 900 €.

Tuttavia è facile calcolare che, mentre per domande multiple comprendenti 20 design il risparmio rispetto alle tasse attuali è notevole, nel caso in cui la domanda multipla comprendesse 50 design le tasse di deposito totali dopo il 1° maggio 2025 sarebbero leggermente più elevate di quelle attualmente applicabili.

Nuove tasse per il rinnovo delle registrazioni di design dell’Unione europea

Le tasse aumenteranno per tutti i quinquenni di rinnovo, ma in particolare per quanto riguarda il 3° e 4°, come indicato in tabella e come mostrato nella seconda parte della simulazione qui di seguito.

Si consiglia pertanto di valutare l’opportunità di pagare anticipatamente eventuali tasse di rinnovo in scadenza prima di ottobre 2025 per evitare gli aumenti che scatteranno il 1 maggio 2025. 

Confronto fra le tasse di rinnovo attuali e quelle nuove, per gli stessi 12 design registrati

	1° quinquennio	150 x 12 = 1.800 € invece di 90 x 12 = 1.080 € aumento: 720 €
	2° quinquennio	250 x 12 =  3.000 € invece di 120 x 12 = 1.440 € aumento: 1.560 €
	3° quinquennio	400 x 12 = 4.800 € invece di 150 x1 2 = 1.800 € aumento: 3.000 €
	4° quinquennio	700 x 12 = 8.400 € invece di 180 x 12 = 2.160 € aumento: 6.240 €

The European Union’s design legislation reform package came into force on 8 December 2024; the changes it brings to both the EU Regulation 6/2002 on Community designs and the EU Directive 98/71 will start coming into force gradually as from 1 May 2025.

We wish to draw your attention in particular to the new filing and and renewal fees for designs of the European Union that will be applicable as from 1 May 2025, as well to the new rules raising the limit on the number of designs that can be included in a multiple application.

We take a look at possible filing and renewal strategies under the new rules.

Change in filing fees and rules

The new filing fees must be read in combination with new filing rules, also coming into effect on 1 May 2025:

1) designs belonging to different classes of the International Classification for Industrial Designs under the Locarno Agreement can be included in the same multiple application for registration.

2) up to 50 designs can be included in the same multiple application for registration.

The combination of the above changes can produce considerable savings on filing fees, as shown in this simulation:

In 2022 an automotive company filed  three multiple design applications

	Application 1	4 different graphical user interfaces in Locarno class 14. Under current filing fees: 350 € for the first design and 175 € for each of the 3 additional designs.
	Application 2	2 wheels rims, in Locarno class 12. Under current filing fees: 350 € for the first design and 175 € for the additional design.
	Application 3	6 car lights in Locarno class 26. Under current filing fees: 350 € for the first design and 175 € for each of the 5 additional designs.
		Total paid by applicant: 2625 €
		Under the new rules and fees applicable as of 1 May 2025, a single application would be possible for all 12 designs costing 1725 €, with savings worth 900 €.

However, it is easy to calculate that while savings with regard to the current fees are considerable for multiple applications including 20 designs, in the case of 50 designs the total filing fees after 1 May 2025 will be slightly higher compared to current fees.

Change in renewal fees

Fees are to increase for all 5-year renewal periods, but in particular with regard to the 3rd and 4^th, as shown also in the second part of the simulation below.

It is therefore advisable to consider paying any renewal fees falling due before October 2025 while the current fees still apply.

Current and new renewal fees compared for the same 12 design registrations

	1st renewal	150 x 12 = 1.800 € instead of 90 x 12 = 1.080 € increase: 720 €
	2nd renewal	250 x 12 = 3.000 € instead of 120 x 12 = 1.440 € increase: 1.560 €
	3rd renewal	400 x 12 = 4.800 € instead of 150 x 12 = 1.800 € increase: 3.000 €
	4th renewal	700 x 12 = 8.400 € instead of 180 x 12 = 2.160 € increase: 6.240 €
