Le mancate ratifiche della Germania e del Regno Unito rendono molto difficile prevedere una data di partenza per il brevetto unitario: un nuovo comunicato ufficiale ora indica la prima metà del 2018.

La partenza del brevetto unitario con validità unica nei paesi UE aderenti, fra i quali l’Italia, slitterà almeno fino al 2018 inoltrato.

A confermarlo è un comunicato ufficiale del Presidente del Comitato Preparatorio del Tribunale unificato dei brevetti, la corte sovranazionale che avrà giurisdizione appunto sul brevetto unitario.

La notizia ufficiale che il Tribunale unificato dei brevetti non aprirà nel 2017 era già stata data qualche settimana fa, quando era emerso che in Germania un ricorso dinanzi alla corte costituzionale ha causato la sospensione dell’iter di approvazione della legge tedesca di ratifica dell’accordo che istituisce lo stesso tribunale.

La ratifica della Germania e quella del Regno Unito sono indispensabili affinché il tribunale possa divenire operativo, e con esso lo stesso brevetto unitario.

Se già sulla ratifica del Regno Unito pendono da oltre un anno seri dubbi sulla compatibilità fra la partecipazione al Tribunale unificato dei brevetti e l’uscita dall’Unione Europea, l’incognita aggiuntiva del ricorso dinanzi alla corte costituzionale tedesca ha ora costretto il Comitato Preparatorio del Tribunale unificato dei brevetti ad ammettere che “nella situazione attuale è difficile mantenere una data d’inizio definitiva”.

Tuttavia il presidente si dice fiducioso che sia il tribunale unificato che il brevetto unitario possano prendere il via nella prima metà del 2018.

Germany and the United Kingdom are delaying the ratification the UPC Agreement, making it very hard to name a starting date for the unitary patent: the latest official communique points at the first half of 2018.

The unitary patent with effect in all EU states that have joined the enhanced cooperation (including Italy) is now expected to kick off in the first half of 2018, as announced by the Chairman of the Unified Patent Court Preparatory Committee in a message published yesterday.

That the Unified Patent Court will not begin operations in 2017 had already been officially confirmed two weeks ago, when it emerged that the approval process of the German law ratifying the Unified Patent Court Agreement had been suspended pending an appeal before the German constitutional court.

However both Germany’s and the United Kingdom’s ratifications are mandatory for the court, as well as the unitary patent itself, to begin operations.

Doubts as to whether the participation in the Unified Patent Court is compatible with an exit from the European Union have been hanging over the United Kingdom’s ratification for over a year.

Now the additional uncertainty brought by the appeal before the German constitutional court has forced the Chairman of the Preparatory Committee of the Unified Patent Court to admit that “under the current circumstances it is difficult to maintain a definitive starting date”.

The chairman hopes nonetheless that the Unified Patent Court Agreement will enter into force by the first half of 2018.
