{"id":3788,"date":"2016-10-14T10:01:30","date_gmt":"2016-10-14T10:01:30","guid":{"rendered":"http:\/\/www.sib.it\/?p=3788"},"modified":"2016-11-22T08:53:13","modified_gmt":"2016-11-22T08:53:13","slug":"un-marchio-sonoro-deve-essere-percepibile-come-marchio-il-tribunale-ue-nel-caso-globo","status":"publish","type":"post","link":"https:\/\/sib.arvis.dev\/en\/flash-news\/un-marchio-sonoro-deve-essere-percepibile-come-marchio-il-tribunale-ue-nel-caso-globo\/","title":{"rendered":"A sound trademark should sound like a trademark, says EU General Court"},"content":{"rendered":"<p>SOUND MARKS IN THE EU<\/p>\n<p><em>The EU General Court has confirmed the EUIPO\u2019s refusal to register a monotonal ringtone as a trademark for lack of distinctive character: the sound was considered exceedingly simple and incapable of conveying a message that consumers can remember.<\/em><\/p>\n<p>Brazilian media group Globo Comunica\u00e7\u00e3o e Participa\u00e7\u00f5es (Globo) applied to register a sound as a EU trademark in 2014.<img decoding=\"async\" class=\"alignright wp-image-3790 size-full lazyload\" data-src=\"https:\/\/sib.arvis.dev\/wp-content\/uploads\/2016\/10\/Listening.jpg\" alt=\"sound mark\" width=\"423\" height=\"283\" data-srcset=\"https:\/\/sib.arvis.dev\/wp-content\/uploads\/2016\/10\/Listening.jpg 423w, https:\/\/sib.arvis.dev\/wp-content\/uploads\/2016\/10\/Listening-300x201.jpg 300w\" data-sizes=\"(max-width: 423px) 100vw, 423px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 423px; --smush-placeholder-aspect-ratio: 423\/283;\" \/><\/p>\n<p>The application included the graphical representation depicted below, and covered a variety of goods and services such as CDs, DVDs and other digital recording media, computer software, applications for tablets and smartphones (in Class 9), paper and cardboard, books, magazines (in Class 16), TV broadcasting services (in Class 38) and entertainment services, TV shows and news (in class 41).<\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-3791 lazyload\" data-src=\"https:\/\/sib.arvis.dev\/wp-content\/uploads\/2016\/10\/sound-mark.jpg\" alt=\"sound-mark\" width=\"224\" height=\"88\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 224px; --smush-placeholder-aspect-ratio: 224\/88;\" \/><\/p>\n<p>The EUIPO\u2019s examiner found that the sound mark applied for consisted of a simple and banal ringing sound that could not be perceived as an indicator of the commercial origin of the goods, and refused the application for lack of distinctive character under Article 7(1)(b) of the Community Trademark Regulation.<br \/>\nThe EUIPO\u2019s Board of Appeal (BoA) dismissed the applicant\u2019s appeal against the refusal, essentially confirming the examiner\u2019s findings.<\/p>\n<p>The applicant turned to the General Court of the European Union (GC), that issued its <a href=\"http:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=183262&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=1034279\" target=\"_blank\">decision in case T-408\/15<\/a> on 13 September 2016, dismissing the appeal. According to the decision, the BoA had been correct in formulating a single ground for refusal of the application since the reason for refusing registration \u2013 the banality of the sign, and the difficulty of using a sound mark in connection to silent products \u2013 applied to all the goods and services.<\/p>\n<p>Regarding distinctive character, the GC observed that Globo itself described the sound mark as resembling a telephone ringtone.
