The Court of Justice of the European Union has ruled on the interpretation of Article 9 of the so-called “Enforcement Directive”, holding that EU Member States must enable courts to issue provisional measures aimed at preventing any imminent infringement of an intellectual property right. When does the exception to the right of reproduction of copyrighted works apply? Italian Supreme Court and CJEU rulings\u00a0<\/span><\/a><\/h3>\n

In its order concerning the Schifano case, the Italian Supreme Court has ruled out that the integral reproduction of an artist\u2019s works, albeit in scale, may qualify as free use of an intellectual work under Italian Copyright Law. The Court of Justice of the European Union has also recently issued guidance on the subject in the Austro-Mechana case. (more<\/a><\/span>) <\/em><\/span><\/td>\n<\/tr>\n

The Italian government has tabled a draft law revising the Industrial Property Code; the changes of direct interest for IP right holders concern geographical indications and denominations of origin, the possibility to defer the payment of the fee for filing a patent application, inventions resulting from university research and the enforcement of IP rights during trade shows.
