{"id":16138,"date":"2020-07-22T13:45:58","date_gmt":"2020-07-22T13:45:58","guid":{"rendered":"http:\/\/www.sib.it\/?p=16138"},"modified":"2020-07-22T13:53:41","modified_gmt":"2020-07-22T13:53:41","slug":"aperta-la-via-diretta-dalla-domanda-internazionale-brevetto-pct-al-brevetto-italiano","status":"publish","type":"post","link":"https:\/\/sib.arvis.dev\/en\/flash-news\/aperta-la-via-diretta-dalla-domanda-internazionale-brevetto-pct-al-brevetto-italiano\/","title":{"rendered":"Direct route from international PCT application to Italian patent now open"},"content":{"rendered":"<p><em>As from 1 July 2020 a PCT international patent application designating Italy may enter the Italian national phase with no need to begin a European regional phase.<\/em><img decoding=\"async\" class=\"size-full wp-image-4560 alignright lazyload\" data-src=\"https:\/\/sib.arvis.dev\/wp-content\/uploads\/2017\/05\/Internazionale.jpg\" alt=\"brevetto internazionale\" width=\"426\" height=\"281\" data-srcset=\"https:\/\/sib.arvis.dev\/wp-content\/uploads\/2017\/05\/Internazionale.jpg 426w, https:\/\/sib.arvis.dev\/wp-content\/uploads\/2017\/05\/Internazionale-300x198.jpg 300w\" data-sizes=\"(max-width: 426px) 100vw, 426px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 426px; --smush-placeholder-aspect-ratio: 426\/281;\" \/><\/p>\n<p>PCT international patent applications designating Italy filed as from July 1, 2020 can enter the Italian national phase with no need to start a European phase, as previously required by Italian Law.<\/p>\n<p>On 2 July 2020 the <a href=\"https:\/\/uibm.mise.gov.it\/index.php\/en\/\" target=\"_blank\" rel=\"noopener\">Italian Patent and Trademark Office<\/a> issued a communication setting forth the operational details of the new procedure, recently enshrined into Italian law (<a href=\"https:\/\/sib.arvis.dev\/en\/flash-news\/direct-route-from-international-application-to-italian-patent\/\" target=\"_blank\" rel=\"noopener\">read more here<\/a>).<\/p>\n<p>Here\u2019s what applicants need to know about entering the Italian national phase directly:<\/p>\n<ul>\n<li>The Italian phase of a PCT application is admitted only in connection with PCT applications filed as of 1 July 2020 designating Italy independently from the designation of the EPO. The Italian phase allows the holder of a PCT application to file an Italian patent application, or alternatively\u00a0an Italian utility model application based on the PCT application.<\/li>\n<\/ul>\n<ul>\n<li>In order to enter the Italian national phase, applicants should file a request with the Italian Patent and Trademark Office including the specification, claims, summary and drawings, if any, of the international application, translated into Italian. The request must be filed within a non-extendable term of 30 months from the international application date. Any subsequent documents regarding said application, including possible amendments to the claims, should also be attached.<\/li>\n<\/ul>\n<ul>\n<li>Late filing is permitted of the documents accompanying the national phase request within the term of 2 months from the filing of the request.<\/li>\n<\/ul>\n<ul>\n<li>It is possible to postpone the above 30-month term for the filing of the request to open the Italian national phase by 2 months under the \u201cfurther processing\u201d procedure, provided an additional fee is paid.<\/li>\n<\/ul>\n<ul>\n<li>The examination of the PCT application will be carried out under the provisions set forth for the examination of national patent applications.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>As from 1 July 2020 a PCT international patent application designating Italy may enter the Italian national phase with no need to begin a European regional phase.
