Creare una nuova varietà vegetale richiede un notevole dispendio di risorse umane ed economiche, e ogni costitutore sa che a questo sforzo deve seguire necessariamente la predisposizione delle condizioni migliori per una valorizzazione commerciale della varietà.

Fra tali condizioni ha un ruolo importante la tutela dei diritti di proprietà intellettuale, che comporta il duplice vantaggio da un lato di tutelare il costitutore dal fenomeno crescente della coltivazione e commercializzazione abusiva e dall’altro di rendere trasferibili i diritti esclusivi di riproduzione della varietà.

La tutela dei diritti sulla varietà dovrà ovviamente partire da una visione strategica che persegua il successo commerciale della singola varietà, tenendo conto degli obiettivi dell’impresa anche nell’ottica di uno sfruttamento del diritto sulla novità vegetale, sia diretto che indiretto.

Ma al di là degli aspetti strategici, riteniamo che sia essenziale per i nostri clienti in questo settore poter contare su un’assistenza completa, finalizzata ad accompagnare il costitutore in tutti gli aspetti del rapporto con il complesso sistema burocratico che presiede alla concessione della tutela per le varietà vegetali: dal dialogo con gli esaminatori degli enti preposti alla concessione di privative sulle varietà vegetali ad ogni problematica che possa sorgere durante l’iter della procedura.

Creating a new plant variety requires the deployment of considerable human and economic resources, and every breeder knows that this effort must be followed by providing the best conditions for marketing the variety.

Protecting intellectual property rights on the plant variety is an important part of those conditions.

Protecting plant breeders’ rights has the double advantage of offering a means to fight unlawful breeding and marketing and of making the exclusive rights on the variety transferrable.

The protection of the plant breeder’s rights will obviously start from a strategic vision that pursues market success of the individual variety while taking account of the enterprise’s objectives as well as of the possibility of exploiting the right both directly and indirectly.
