ITALIA
Le disposizioni sulla sospensione dei termini per brevetti, marchi e design promulgate dall’Ufficio Italiano Brevetti e Marchi (UIBM) in data 11 marzo 2020 (vedi notizia) sono state ampliate dal Decreto Legge 18 del 17 marzo 2020 (cd “Cura Italia”) e dal Decreto Legge dell’8 aprile 2020, n. 23 con i seguenti effetti:
Le nuove disposizioni sospendono tutti i termini fissati dal Codice della Proprietà Industriale e dall’Ufficio Italiano Brevetti e Marchi con scadenza nel periodo compreso fra il 23 febbraio e il 15 maggio 2020.
Come si calcola il periodo della sospensione
I giorni rimanenti fra la data della sospensione e la data della scadenza del termine decorreranno di nuovo a partire dal 15 maggio 2020.
Termini che iniziano a decorrere durante il periodo di sospensione
Nel caso in cui i termini, per una determinata attività (quale il deposito di un atto o una risposta all’ufficio), inizino a decorrere da una data che cade fra il 23 febbraio e il 15 maggio 2020, la data iniziale di decorrenza slitta al 15 maggio 2020.
Annualità e rinnovi
I titoli di proprietà industriale in scadenza a partire dal 23 febbraio 2020 sono prorogati fino al 15 giugno 2020. Pertanto i pagamenti di annualità e/o le richieste di rinnovo per i brevetti, i marchi, i design che ove non rinnovati scadrebbero nel periodo tra il 23 febbraio 2020 e il 15 maggio 2020, devono essere effettuati entro il 30 giugno 2020.
EUROPA
Marchi UE e design comunitari
L’Ufficio dell’Unione europea per la proprietà intellettuale (European Union Intellectual Property Office – EUIPO), che gestisce la registrazione di marchi dell’Unione Europea e design comunitari, ha pubblicato una decisione che proroga al 1 maggio 2020 tutti i termini in scadenza fra il 9 marzo 2020 e il 30 aprile 2020 riguardanti tutti i procedimenti in corso dinanzi all’EUIPO.
Brevetti europei
L’Ufficio europeo dei brevetti (European Patent Office – EPO), che gestisce il rilascio di brevetti europei, ha predisposto una pagina di aggiornamenti sul Coronavirus.
Ufficio comunitario per le novità vegetali
L’Ufficio comunitario per le novità vegetali (Community Plant Variety Office – CPVO) ha prorogato al 4 maggio 2020 le scadenze che cadono dal 17 marzo al 3 maggio 2020 per tutti i soggetti in procedimenti dinanzi al CPVO e alla Commissione di ricorso.

ITALY
The suspension of terms announced by the Italian Patent and Trademark Office on 11 March 2020 (more here) has been extended by two successive law decrees dated 18 March and 9 April 2020.
The effect of the above measures is the suspension of all terms provided for by the Italian Industrial Property Code and by the IPTO falling from 23 February to 15 May 2020.
How to calculate the period of suspension
The remaining days between the date of the suspension and the date of the term’s expiry will start running again from 15 May 2020.
Terms that start running during the suspension period
Where terms for a certain activity (such as the filing of a deed or an answer to the office) start running from a date falling from 23 February to 15 May 2020, the initial running date is postponed to 15 May 2020.
Annuities and renewals
The validity of intellectual property rights expiring on 23 February 2020 or later is extended until 15 June 2020. Therefore annuity payments and/or requests for renewals concerning patents, trademarks or designs that unless renewed would expire during the period between 23 February and 15 May 2020 must be finalised by 30 June 2020.

European Union Intellectual Property Office
The European Union Intellectual Property Office (EUIPO) has published a decision that extends until 1 May 2020 all time limits expiring from 9 March 2020 to 30 April 2020 that affect all parties in proceedings pending before the EUIPO.

The European Patent Office (EPO) is continually updating its Coronavirus information page.
Community Plant Variety Office
The Community Plant Variety Office (CPVO) has issued a decision to extend until 4 May 2020 deadlines falling from 17 March to 3 May included, for parties in proceedings before the CPVO and the Board of Appeal.
